Amapola Farms LLC ("Amapola," "we," "us") provides The Amapola Brief, a subscription market regime intelligence newsletter, and related managed pilot services (collectively, the "Service"). The Service is operated from Washington State, United States.
By subscribing to or using the Service, you agree to be bound by these Terms of Service. If you do not agree, do not subscribe or use the Service.
The Service provides market regime intelligence for informational and educational purposes only. It does not constitute investment advice, a recommendation to buy or sell any security, or an offer to provide investment management services. You should consult a qualified financial advisor before making investment decisions.
Amapola Farms LLC does not manage investment portfolios, execute securities transactions, or exercise discretion over any subscriber's assets. The service delivers identical market regime intelligence to all subscribers without personalization or tailoring to individual portfolios.
The operator of Amapola Farms LLC may hold positions in securities, ETFs, or other instruments referenced in regime assessments and market analysis, including but not limited to SPY, VIX-related products, Treasury securities, high-yield credit instruments, and cryptocurrencies. Regime classifications and analysis are generated by automated systems and are not influenced by the operator's personal holdings. All subscribers receive identical content.
All content, data, analysis, and materials delivered through the Service are the property of Amapola Farms LLC. Subscribers may use the content for their own internal purposes but may not redistribute, resell, or publicly republish it without written permission.
The Service is provided "as is." Amapola makes no warranties regarding the accuracy, completeness, or timeliness of the information provided. In no event shall Amapola be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months.
We aim to deliver the Service reliably but do not guarantee uninterrupted access. Market data depends on third-party providers that may experience outages or delays. Scheduled maintenance will be communicated in advance when possible.
We may update these Terms from time to time. Material changes will be communicated to active subscribers via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
In the event of any dispute arising out of or relating to these Terms or the Service, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute is not resolved within 30 days, the parties agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in King County, Washington. Each party waives any objection to personal jurisdiction or venue in such courts.
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.
